Steps to Obtain a Canadian Work Permit

Step 1: Employers May Submit a Labour Market Impact Assessment (LMIA) Application, If Required

What is an LMIA?

Before hiring a foreign worker, most Canadian employers must obtain an LMIA. This document, issued by Employment and Social Development Canada (ESDC), confirms that hiring international workers will not negatively impact Canadian labor. Employers need to demonstrate that they tried to hire Canadian citizens or permanent residents but couldn’t find a suitable candidate. The LMIA ensures the job offered to the foreign worker is legitimate and that wages and working conditions meet Canadian standards.

In What Situations Is an LMIA Not Necessary?

In some cases, international workers can obtain a work permit without requiring an LMIA. These LMIA-exempt work permits are granted under specific conditions, such as:

  • International Agreements: Trade agreements like CETA, NAFTA, and CPTPP allow work permits under certain provisions.
  • Canadian Interests:
    • Work that benefits Canada economically, socially, or culturally.
    • Reciprocal agreements, such as youth or teacher exchange programs.
    • Co-op placements for international students as part of their studies in Canada.
    • Spouses or common-law partners of specific work or study permit holders.
    • Individuals doing religious or charitable work.
  • Other Circumstances:
    • Refugee claimants in Canada needing to support themselves.
    • Certain permanent residence applicants.
    • Migrant workers with employer-specific permits facing abuse, along with their dependents.

Step 2: Employer Extends a Temporary Job Offer

Once the LMIA yields favorable or neutral results, the Canadian employer must provide the foreign worker with the LMIA approval letter and a comprehensive job offer. These documents are essential for the foreign worker to apply for a Canadian work permit.

Step 3: Foreign Worker Applies for a Work Permit

Using the LMIA confirmation letter, job offer, and, if required, a Certificate of Acceptance of Quebec (CAQ), the foreign worker can apply for a work permit through Immigration, Refugees, and Citizenship Canada (IRCC). Workers from countries that require a Temporary Residence Visa (TRV) must apply for their work permit at a Canadian visa office outside Canada.

Step 4: Issuance of Work Permit

If the application is approved, the foreign worker receives a letter of introduction to enter Canada. In some cases, a visitor visa or electronic travel authorization (eTA) is issued. The actual work permit is provided upon arrival at a Canadian port of entry, where an immigration officer verifies the worker’s documentation and job details.

The work permit specifies conditions such as the employer’s name, job location, and employment duration. Workers must adhere to these conditions to maintain their status in Canada. To change jobs or extend their stay, workers must apply for a new work permit or renew their current one before it expires.
